Preptika (hereinafter "the Service") is an online software platform (SaaS) providing automated prepress and graphic file preflight tools (hereinafter "the Tools").
These General Terms of Use (TOU) govern the access and use of the Service by any User, whether using free or paid features. The purchase of Credits and the associated commercial terms (pricing, payment, right of withdrawal, refunds) are governed by a separate document: the General Terms of Sale (TOS), available on the Terms of Sale page, which apply in addition to these Terms once a purchase is made.
Any use of the Service implies full and unreserved acceptance of these TOU.
2.1. These TOU define the conditions under which the Publisher makes the Service available to Users, and the rights and obligations of each party in this context.
2.2. They apply to all features of the Service, including those accessible without an account or payment (Preflight, Preview, free tools).
2.3. They do not govern the financial and contractual conditions of purchasing Credits, which are subject to the Terms of Sale.
3.1. Some features are accessible without an account. Others require the creation of an account (email + password, or third-party authentication).
3.2. The User guarantees the accuracy of the information provided and is responsible for maintaining the confidentiality of their credentials and all activity performed from their account.
3.3. The User must be at least 16 years old (or the applicable age of digital majority in their jurisdiction) or have the permission of a legal representative.
3.4. The Publisher reserves the right to suspend or close an account in the event of a breach of these TOU, particularly Article 5.
4.1. The Service is a self-service software tool (SaaS). The User uploads a file, selects a Tool, and receives a result generated automatically by the system.
4.2. No consulting services, individualized support, custom creation, or manual intervention on the User's files are offered as part of the Service. The Service consists exclusively of providing an automated software tool.
4.3. Service Phases & Member Statuses:

Immediate Computational Service: Generating a preview via Artificial Intelligence tools constitutes an immediate computational service performed upon the User's request and is therefore strictly non-refundable, regardless of the final aesthetic rendering produced by the AI. The User agrees that the deduction of 1 token (credit) for the preview is final once calculation begins.
4.5. Acceptance of Rendering: Final validation by the User and deduction of the remaining tokens (3 additional tokens) for downloading the high-definition file (300 DPI) constitute full and unreserved acceptance of the preview result. No refund or credit return will be granted for aesthetic discrepancies or path differences after unlocking the final file.
5.1. The User agrees to use the Service in accordance with its purpose and applicable law.

5.3. The Publisher exercises no prior control over the uploaded files and disclaims all liability for their content or legality, the sole responsibility for which lies with the User.
5.4. In the event of a breach, the Publisher may suspend access to the Service without notice or compensation, without prejudice to any legal action.
6.1. Nature of Support. Since the Service is an automated self-service tool, no individualized technical assistance, project support, or custom creative or commercial advice is offered.
6.2. Open Documentation. The User has access to documentation, a Frequently Asked Questions (FAQ) section, and tutorials to help them use the Service independently.
6.3. Contact Channel. For any questions regarding a proven technical malfunction of the Service, or billing/payment issues covered by the Terms of Sale, the User can send a message via the contact form or to support@preptika.com.
6.4. Processing Time. Requests are processed within an estimated timeframe of 3 to 5 business days, excluding French weekends and public holidays. This timeframe corresponds to the operation of a service published and maintained asynchronously, without any real-time availability commitment (no live chat, no phone support).
6.5. Communications through this channel are strictly limited to reporting technical malfunctions or payment/billing issues. They do not constitute a consulting, training, or coaching service, and cannot be interpreted as a service distinct from the software itself.
7.1. The Service, its code, interface, graphic chart, and documentation are the exclusive property of the Publisher and are protected by copyright and, where applicable, trademark law.
7.2. The files uploaded by the User remain their exclusive property. The Publisher claims no rights over these files and agrees not to exploit them for any purpose other than executing the requested Processing.
7.3. Uploaded files are temporarily stored for processing and then deleted in accordance with the technical retention policy described in the Privacy Policy, unless the User explicitly chooses to save them in their account space.
7.4. Any unauthorized reproduction, extraction, or reuse of the Service or its components is prohibited.
8.1. Data collected (email, technical data, uploaded files) are processed in accordance with the General Data Protection Regulation (GDPR) and applicable privacy laws.
8.2. Data processing is described in a separate Privacy Policy, available on the Privacy Policy page, which prevails over any general provisions of these TOU regarding personal data.
8.3. The User has a right to access, rectify, erase, and export their data, which can be exercised via support@preptika.com.
9.1. The Publisher endeavors to ensure the availability and proper functioning of the Service, without any guarantee of continuous availability (the Service is provided "as is" and "as available").
9.2. The Publisher shall not be held liable for any data loss resulting from non-compliant use, service interruption beyond their control, force majeure, or the User's decision not to keep a copy of their original files.
9.3. The limitations of liability associated with purchasing Credits (legal warranty of conformity, hidden defects) are specified in the Terms of Sale.
10.1. These TOU are governed by French law.
10.2. For consumer Users residing in the European Union, the mandatory consumer protection provisions of their country of residence remain applicable notwithstanding the choice of French law, in accordance with Regulation (EC) No 593/2008 (Rome I).
10.3. Any dispute relating to the use of the Service shall be submitted, in the absence of an amicable settlement, to the competent courts under the rules of common law applicable to the place of residence of the defendant User.
The Publisher reserves the right to modify these TOU at any time. Users will be informed of any material change by email or notice on the Platform, with reasonable notice before application.
If any provision of these TOU is found to be invalid or unenforceable, the remaining provisions shall retain their full validity.
